1. Purpose and scope

The purpose of these General Conditions is to regulate the relationship between 15 Spanish Cellars SL and you (hereinafter, the Customer), regarding all transactions carried out in the Company's online shop.

15 Bodegas is a Spanish company, registered in the Commercial Register of Barcelona, Sheet B-62,284, Volume 23,827, Folio 45, with Tax ID number A- B88541156 and registered office in Haro, Estación s/n.

Any incident, complaint or claim regarding a purchase made through the website must be sent to the following email address: cuentanos@15bodegas.com.

2. Exclusions

The sale of alcoholic beverages of any strength to minors is prohibited.

In addition, the products offered by 15 Bodegas through the Company's online store are not intended for countries where the consumption of alcoholic beverages is prohibited.

3. Acceptance and proof of acceptance

The products must be purchased by activating the BUY button that appears at the bottom of the purchase request page, and this implies total acceptance of these General Conditions prior to the purchase of the products, without any subsequent additions to the clauses of the General Conditions being applicable.

Once these General Conditions have been expressly accepted, 15 Bodegas will send the Customer proof of the purchase made, with all its terms, by e-mail within 24 hours of purchase.

15 Bodegas informs you that it files the electronic documents in which the purchases are formalized.

In the event of the Customer making an error when sending the data, he/she may rectify it in the Customer Service Section, by calling 935 05 15 15 or writing to cuentanos@15bodegas.com. If the data rectified is the postal address where the Customer has requested that the purchased product be delivered, provided that the product has not already been shipped, said shipment will be made to the new address provided. Otherwise, the Customer must wait for the delivery to take place and then initiate the appropriate return procedures, as described in section 4.4. below.

4. Prices, Method of Payment, Delivery and Cancellation

4.1. Prices

The prices applicable to each product are those indicated on the website on the date of the order, including VAT (Value Added Tax) and any other taxes that may apply.

Offers shall be duly marked and identified as such, indicating the previous price and the offer price accordingly.

15 Bodegas reserves the right to make changes to the website at any time and without prior notice, and may update products and services on a daily basis depending on the market.

The applicable shipping costs are always indicated on the order.

4.2. Method of payment

Once the Customer has confirmed the purchase of the product, he/she must proceed to pay the specified price. Purchases can be paid for by any of the following means:

- Through the "La Caixa" payment gateway.

- By PayPal (you can pay with your PayPal account or with your debit or credit card).

- Cash on delivery (this has an additional cost of €3 which will be specified at the time this payment method is selected)

- Bank transfer is a payment method exclusively for companies.

In order for 15 Bodegas to be able to take the necessary steps, the Customer shall notify 15 Bodegas as soon as possible of any undue or fraudulent charges. Such notification may be sent to the above e-mail address or by calling the above telephone number.

4.3. Delivery

Deliveries are sent to the delivery address indicated by the Customer, within 24 - 72 working hours for deliveries in the Iberian Peninsula and within 7 days for the Balearic Islands and abroad for products in stock. The services will be provided from Monday to Friday, public holidays in the place of destination town being excluded from the calculation of the delivery period.

For those orders that include custom bottles the delivery time is 10 - 15 working days.

For the delivery of packs that include an Iberian pork shoulder, to guarantee its quality, the delivery of the latter will be made directly by the supplier, so the delivery time may be different from that of the wines.

If the Customer does not receive the order by the specified deadline, he/she can contact 15 Bodegas through the Contact section of the website.

In the event of failure to meet the delivery deadline, the compensation to be paid shall consist of the return of the postage paid by the customer. Late delivery caused by the absence or change of address of the recipient, unknown recipient or address, non-payment of postage, supplements or refunds, closure for holidays, late deliveries on the second attempt at delivery, causes of force majeure or unforeseeable circumstances or others not attributable to the carrier shall not be considered failure to meet the delivery deadline. The company is also exempt from liability in cases of failure to meet the delivery deadline for shipments to the Balearic Islands or international shipments for reasons beyond the carrier's control (delays of airlines, shipping companies, carriers, loading and / or unloading, etc.).

4.4. Cancellation

15 Bodegas guarantees to the Customer the possibility of cancelling the order at any time as long as the cancellation is communicated before the order has been shipped or before its production in the case of the personalized bottles. Otherwise, the customer will have to wait until receiving the order to order its cancellation.

The Customer shall have a period of 7 working days from the formalization of the purchase to cancel the order.

The Customer shall inform 15 Bodegas within the stipulated term and by any means permitted by law, of his/her wish to exercise his/her right to cancel the order.

The returned order must be delivered together with the delivery note and, if applicable, an invoice issued by 15 Bodegas. The return costs will be charged to the Customer. The Customer may return any item purchased from 15 Bodegas, except for the personalized bottles, provided that the products have not been opened, used and retain their original seal or packaging. The cost of return will be calculated and communicated through our Customer Service channel. We are not responsible for packages that do not reach their destination, so we recommend using our secure tracking service for returns.

After checking the status of the product(s), the amount will be refunded through the same payment method used by the Customer. We will process the refund as soon as possible. However, during periods of high activity, the refund may take 7 to 15 business days to be processed.

If a product other than the one requested by the Customer is delivered by mistake by 15 Bodegas, the correct product will be delivered to the Customer and the erroneous one collected, at no additional charge to the Customer.

If a product reaches the Customer broken, damaged or in bad condition, 15 Bodegas will collect it and replace it with another in good condition, with no additional charge.

5. Language

The language in which the contract between 15 Bodegas and the Client will be concluded will be Spanish, Catalan or English, depending on the language selected on the website.

6. Responsibilities of 15 Bodegas

15 Bodegas guarantees the quality of the service hired through the website. All the rights guaranteed to consumers and users by current legislation are guaranteed.

Failure to comply with any of these General Conditions may result in the return of the products or the cancellation of the Services hired by the Customer.

7. Responsibilities of the Customer

The Customer undertakes to make lawful use of the Products and Services, without contravening current legislation, or harming the rights and interests of third parties.

The Customer guarantees the truthfulness and accuracy of the data provided when filling in the procurement forms, avoiding the causing of damages to 15 Bodegas as a result of their inaccuracy.

9. Jurisdiction and applicable law

In the event of any dispute regarding the interpretation or application of these contractual terms and conditions, in the case of end consumers, the courts of the place of performance of the obligation or of the domicile of the purchasing party shall have jurisdiction in accordance with the applicable regulations.

In the case of a purchase made by a company, both parties, expressly waiving any other jurisdiction, submit to the Courts of Barcelona (Spain).
